Wellesley Information Services Impact 2012 Pass Contest/Drawing Rules and Terms

The contest is run, managed, and produced by Wellesley Information Services and is not offered or affiliated with IBM. The Contest is open to all WebSphere IT professionals. Employees, officers, directors, representatives, and immediate family members of IBM or Wellesley information Services and their respective parent companies, affiliates, and subsidiaries are not eligible to participate in this Contest. Government employees may not participate.

The Contest entries and Prize(s) are not redeemable for cash and are not transferable or assignable wthout the previous written consent of Wellesley Information Services. A transfer fee may apply. All winner(s) are responsible for the payment of any and all taxes and/or licenses and/or other related local, State, Federal fees that may apply to such winnings. Taxes on prizes are solely the responsibility of the winner(s). the prize is one pass to Impact 2012 conference in Las Vegas and DOES NOT INCLUDE transportation, lodging, meals outside of those included with a conference pass, or any other expenses of any kind.

Contest promoters, Wellesley Information Services is not responsible for lost or stolen entries. Contest entries will be disqualified, at the sole discretion of Wellesley Information Services, if attempts are made to disrupt the Contest or circumvent the terms and conditions of these Official Rules. If the above occurs, Wellesley Information Services reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by Wellesley Information Services to be fair and equitable to Contest participants.

Contest entrants, by entering the contest, agree and consent to use of their name, likeness, company name and any other information needed to promote the contest winner on the GWC site, in other Wellesley Information Services publications, sites, or offerings, and agree to participate in interviews, podcasts, or other activities with the GWC for the purposes of such promotion.

Wellesley Information Services reserves the right to replace the advertised prize(s) with a prize of equal or greater value if the advertised prize(s) is/are no longer available. Wellesley Information Services will not be responsible for replacing any lost or stolen elements of any prize package. If multiple prizes are indicated, all prizes will be awarded. Odds of winning depend on the number of eligible entries received, according to the eligibility requirements in this Contest.

Any random drawings required to select Winner(s) of the Contest will be held under the supervision of Wellesley Information Services and within 2 months of the end of the Contest. All decisions by Wellesley Information Services are final and binding. Winner(s) will be notified by e-mail. Each winner may be required to provide Wellesley Information Services with proof that he or she is the authorized account holder of the e-mail address associated with the winning entry. The "authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to return a completed and executed affidavit and release as required, an alternate winner may be selected. Except where prohibited by law, acceptance of any prize constitutes permission for Wellesley Information Services to use the winner's names, photographs, likenesses, voices, addresses (only city and state), and testimonials, in print, broadcast, or new media, in perpetuity, in any manner they deem appropriate in connection with promoting this or any other Contest and/or promotion sponsored by them without further compensation.

CONDITIONS: By entering, participants agree to be bound by these complete Official Rules and the decisions of Wellesley Information Services, which shall be final. All federal, state, and local laws apply. Wellesley Information Services and its employees, officers, directors, agents, and representatives and their parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) failed, returned, or misdirected notifications based on inaccurate information provided by the winner; or (iii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties resulting from participation in this Contest of otherwise; (iv) errors in transmission; (v) any condition caused by events beyond the control of Wellesley Information Services that may cause the Contest to be disrupted or corrupted; (vi) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Contest; or (vi) any printing or typographical errors in any materials associated with the Contest.

Participation in the Contest will automatically enroll you in the Wellesley Information Services follow-up email list as well as the Contest.
The Contest shall be construed and governed by, and any and all actions or claims in any way related to this Contest are subject to, the federal laws and regulations of the United States, the state laws and regulations of the Commonwealth of Massachusetts, and local laws and regulations of Norfolk County, Massachusetts. Any and all actions or claims in any way related to this Contest shall be filed in the courts of the State of Massachusetts, County of Norfolk. By Providing an Entry to this Contest, you submit to the jurisdiction of the courts of the State of Massachusetts in the United States for any and all actions or claims in any way related to this Contest, and expressly agree that such actions or claims are subject to the federal laws and regulations of the United States, the state laws and regulations of the State of Massachusetts, and local laws and regulations of the County of Norfolk, Massachusetts. Wellesley Information Services may prohibit you from participating in the Contest, if at the sole discretion of Wellesley Information Services, you repeatedly show a disregard for the Contest Official Rules, or act (1) in an unsportsmanlike manner; (2) with an intent to annoy, abuse, threaten, or harass any other player or a representative of Wellesley Information Services; or (3) in any other disruptive manner.

RELEASES. By participating, entrants agree that Wellesley Information Services, those involved in the development, production, implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third-party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third-party claims, damages, losses or injuries, arising from or relating to a participant's entry or participation in this Contest, they will indemnify Wellesley Information Services from any and all such claims, including the attorneys' fees related thereto. Wellesley Information Services shall not be liable for entries and winner notification responses that are delayed, lost, misdirected, mis-delivered, marked postage-due, illegible, mutilated, incorrect or incomplete, and such entries will be not be eligible for this Contest. Any person attempting to defraud or in any way tamper with this Contest will be ineligible for prizes and may be prosecuted to the full extent of the law. Wellesley Information Services reserves the right, in their sole discretion, to cancel or suspend this Contest should viruses, bugs or other causes beyond their control corrupt the administration, security or proper play of the Contest. Wellesley Information Services further reserves the right to modify the rules of the Contest in any way or at any time, as long as reasonable notice is given. For an Official Winners List or a copy of these Official Rules, send a note requesting such and a self-addressed, stamped envelope (WA and VT residents need not affix postage) to Wellesley Information Services Manager, GWC User Group Meetings Poll Results, 20 Carematrix Dr., Dedham, MA 02026. Replies will be sent after the completion of the Contest. Winners List requests must be received within 30 days of completion of the Contest.
